Oral Arguments Recordings

There is a library of Oral arguments held at the Fifth Court of Appeals.

You can search the library here, it holds recordings from 2008 – present;

http://www.ca5.uscourts.gov/oral-argument-information/oral-argument-recordings

There were 4 oral recordings pertaining to Deutsche Bank foreclosure cases in that period.

Who is Mark Daniel Hopkins?

We have always maintained Hopkins has “connections” and is conspicuously absent or invisible (to the maximum extent possible).

A search of the Fifth Circuit library of oral argument recordings yields zero results for Mark Daniel Hopkins.  This is a man who has been in the courts in Texas for over two decades.

His new wife, ex BDF attorney Shelley Luan Hopkins even appears in the search…but it’s Mark Hopkins that argued the case (see audio herein) so it begs the question, who is Mark Hopkins?

Why is there no results in the Court of Appeals in his name and why was his free brief template added to the Court website over all others?

Reinagel vs DB

Quotes by Judge Higginbotham in Reinagel Appeal.

“No free lunch or free houses to homeowners…”

(starts quote at 36.25 mins +)

“Hope they are putting money aside to pay right person..”

(starts quote at 28.44 mins +)

There is a lot of conversation about “forgery” and “fraud” pertaining to affidavits and notary signatures. How the Court dismisses the criminality of these actions and how they choose to interpret the law in Texas, in particular Higginbotham, is quite alarming.

Diaz vs DB

Quotes by Judges in Diaz Appeal.

Full transcript

As in the Burkes’ case, the staff at IndyMac Bank advised Joanna Burke on a phone call, in order to qualify for a loan modification, we had to stop being current on the loan and go into a min. of 3 months arrears.

As you can see, this was a standard bait line given to homeowners in Texas to enable the Bank(s) to start foreclosure proceedings.

“I’ve seen at least 50 of these claims…”
